Disability Discrimination
The Disability Discrimination Act makes it unlawful for an employer to subject a disabled person to a detriment unless he can show that such treatment is justified.
There is a further duty which is a positive duty on employers to provide “reasonable adjustments” to working practices to make it possible for disabled employees to work so as not to be treated less favourably because of their disability. This legislation will also apply to job applications to the employer and the treatment of sub-contractors.
The requirement for reasonable adjustments applies to all employers no matter what the size of the business or the number of employees.
There are many and varied health conditions that may amount to a disability in law.
