Racial Discrimination
The law protects against a person being treated less favourably on grounds of race which includes race, colour, nationality, and ethnic or national origins.
Direct discrimination involves treating someone less favourably because of their race.
Indirect discrimination is where a practice creates an obstacle that substantially affects one race as compared to another. In the case of indirect discrimination there is a defence that the employer can use on the basis of “justification” if it is determined that there is discrimination.
