Sex Discrimination
The law protects against a person of one sex being treated less favourably than a person of another sex where the reason for the less favourable treatment is the person’s sex.
Direct discrimination involves treating someone less favourably because of their sex.
Indirect discrimination is where a practice creates an obstacle that substantially affects one sex as compared to another. In the case of indirect discrimination there is a defence that the employer can use on the basis of “justification” if it is determined that there is discrimination.
